ABOUT
THESE TERMS AND CONDITIONS
In these Terms and
Conditions "we" and "us" mean Deliss Pty Ltd and "you" means you the customer.
AUSTRALIAN SALES ONLY
We only sell and
ship Products within Australia. We will not make deliveries outside of
Australia.
LEGAL CAPACITY TO TRANSACT
If you are under
the age of eighteen (18) years you cannot place orders with www.deliss.com.au.
By accepting these Terms
and Conditions you acknowledge that you are over the age of eighteen (18)
years.
Should
www.deliss.com.au suffer any damage or other losses as a result of a
transaction entered into by a minor, www.deliss.com.au reserves the right to
seek compensation for such losses from the parents or guardians of the minor
who caused any order(s) to be placed with www.deliss.com.au.
DELIVERY
Delivery restrictions
Please note, we
are unable to deliver to Post Office Boxes.
Please beware, for perishable
products we only deliver to customers who live within a 50km radius of
each state capital city in Australia excluding WA and NT. (please check the related
section below)
Where living outside these areas please contact us at admin@deliss.com.au for a quote and delivery information.
For orders of non-perishable
products only, we can ship anywhere in Australia.
We will use all reasonable efforts
to deliver Products for accepted orders to the address specified on the
delivery slip, on or before any estimated date, but we do not represent or
warrant that we will do so. We do not accept liability, whether for direct,
indirect or consequential loss or damage arising due to any delay in delivery
of the products or any failure to deliver the products to You for whatever
reason.
It is
your responsibility to check the quantity, quality and description of the
products delivered against the details on the delivery slip. If there is any
difference in quantity, quality or description of the products delivered, you
must notify us at admin@deliss.com.au
within
48 hours from the time of delivery or collection by you (whichever is the
later). If notice is not given within 48 hours, the Products actually delivered
shall be deemed to be in accordance with the delivery slip and you shall not be
entitled to make any claim or take any action in relation to any alleged
deficiency or irregularity in the Products after that time.
Perishable
Products
We take great care
with the shipping of your order to ensure that it arrives in optimal condition.
To ensure that your order does not get too hot, we use a combination of
polystyrene boxes combined with ice packs.
Orders containing
perishables are shipped Monday, Tuesday and Wednesday to
minimise the chance of orders being held over in transit over a weekend.
During extreme
weather events we may suspend shipping perishables and you will be advised of
the status of your order. Orders containing perishables will travel well for 48
hours.
All products
Depending on the
nature of the products, we use either a courier service or Australia Post
services but do not deliver perishable products to Western Australia or
Northern Territory as freight takes too long which can result in damaged
products upon delivery. (See “Perishable Products” section above)
Deliveries by
courier must be signed for, so if it is possible please get your order
delivered were someone will be able to sign for your shipment during business
hours. In the event that the parcel cannot be delivered, a card will be left by
the driver explaining how pickup can be arranged. Please note, that we cannot
accept liability for, or process a claim on an order for a perishable product
delivered where a signature cannot be obtained.
If you order on a
Friday during the warmer months, we will sometimes delay shipping to the
following Monday to ensure that your order does not get left in a warm
warehouse over the weekend.

Please be aware
that given the freshness of our products, special delivery time may occur for
some of them. Please check carefully the product description for specific
delivery time.
Goods Damaged on
Delivery
We will replace any
order that has reached you in an unacceptable condition. However, we cannot be
held responsible if you are not present when your order is delivered, please
ensure you get your order shipped were it can be signed for during business
hours. Please note that if nobody is available to sign for delivery a card will
be left allowing you to call our courier and arrange another delivery time or
pickup from a local post office.
Disclaimer
We believe that we
have aligned ourselves with excellent delivery partners, but there may be times
when, despite their best efforts, parcels are delayed in the delivery process.
We will always endeavour to work with our delivery partners to ensure prompt
arrival of your products.
Returns
and Refunds
We cannot exchange
or refund goods due to the perishable nature of our range of products, so
please order carefully.
We can only refund
your order if it has not yet been shipped, once your order has left our warehouse we
can no longer refund your order. Please note that almost all orders ship same
day, so let our customer service know as soon as you are able if you wish to
cancel your order.
Payment Options
We accept payment
made by credit card (see below), Paypal, Cheque, Money order, and E.F.T
(Electronic Fund Transfer).
Credit Card
Purchasing online
with your credit card is the simplest and most convenient way of shopping. For the best protection of your payment
details, we process credit card payment through PAYPAL which accepts most major
credit cards: VISA & MasterCard.

by credit card using PAYPAL service.

and will not wilfully disclose any personal information regarding you without
first obtaining your permission, unless required by law. We have set out below
our information gathering and usage practices of personal and non-personal
information we collect when you visit our site.
Disclosing Your
Information
Third party
companies and individuals have been engaged to perform functions on behalf of
Deliss. Functions such as fulfilling and delivery of purchases, credit card
payment authorisation, but all information will only be used to perform their
appropriate functions and not for other usage.
Deliss will pass on
any information relating to suspected fraudulent activity to appropriate
authorities.
Product Information
Prices of goods and services and delivery and other charges
displayed on the deliss.com.au website are current at the time of display.
These prices are subject to variation without
notice. We will always attempt to be as accurate as possible with
our product descriptions and pricing. However, we are unable to warrant that
product descriptions or other content of the website is accurate, complete,
reliable, current or error free. Some products on deliss.com.au may not be
immediately available for dispatch, due to circumstances beyond our control.
However, where
possible, we will advise you of any delay by advertising the release or
campaign (sale) date accordingly. By submitting your order after being advised
of such delays, you are accepting such timeframes into which the item/s will be
shipped. If there are any changes in the release date to which you have
previously accepted, we will contact you accordingly.
Placing and
Accepting Orders
Orders will not be
dispatched until payment in full has been received and deliss.com.au is
satisfied with the integrity of the order.
Without limiting
the operation of any other Terms and Conditions herein, deliss.com.au is not
responsible for any loss or damage caused by late delivery or cancellation of
an order or a product. Placement of an order by you constitutes an offer to
enter into an agreement with us (“your offer”).
We will email you
an Order Confirmation for the sole purpose of confirming the details of your
offer. Please note that our Order Confirmation does not constitute an
acceptance of your offer or reflect the status of your order in any way.
Cancellation by
Us
We reserve the
right not to provide goods or services, terminate membership accounts, remove
or edit content or cancel orders (or part thereof) at our sole discretion at
any time. Without limiting the operation of any other Terms and Conditions
herein, we will not be held liable for loss or damage arising from the
exercising of these rights.
Cancellation by
You
If you need to
cancel an order, please contact us immediately at admin@deliss.com.au.
Our agreement with
you only comes into existence once we have both confirmed your order and your
payment has been processed. Once we have accepted payment for an order,
cancellation of the order is within our sole discretion.
Orders that cannot be cancelled will be subject to our terms, conditions and
policies relating to Returns and Exchanges.
Risk and title
Ownership of the
Products shall remain with us and we reserve the right to dispose of the
Products until such time as payment in full is made for all amounts owing by
You to us. The risk in the Products purchased will, unless otherwise agreed by
us in writing, pass to You upon delivery to a carrier commissioned by us to
deliver the Products.

is basis and makes no claims of suitability for any particular purpose.
Deliss will not be held responsible for
any loss, damage or injury caused by, or related to, the use of any information
